Terms and Conditions
The rules, rights, and responsibilities related to using CabinCrew.uk, including access to courses, digital products, and recruitment preparation services for cabin crew candidates in the United Kingdom.
- General provisions
- These Terms and Conditions set out the rules for using the website operating at www.cabincrew.uk (hereinafter referred to as the "Service", "Application" or "CabinCrew.uk") operated by Pro Wojciech Cywinski (hereinafter "PWC" or "Service Provider"), ul. Bernardyńska 23/65, 02-904 Warsaw, Poland, registered in the CEIDG business register under NIP: 5213369140, REGON: 141055055.
- The Service enables users to browse online offers of services provided by CabinCrew.uk and to place orders for Products available therein – in particular on-site and/or online courses, digital products supporting the airline recruitment process, including individual and group recruitment tasks, as well as educational materials in the form of questions and answers on recruitment stages, including Final interview.
- Use of the Service is free of charge.
- These Terms and Conditions define the rights and obligations of CabinCrew.uk and users of the Service. PWC provides services within the Service in accordance with these Terms.
- Use of the Service constitutes acceptance of these Terms. Every user should read the Terms before starting to use the Application. A user who does not agree to these Terms should cease using the Service.
- The user may not place unlawful content on the Service.
- PWC does not provide telecommunications services within CabinCrew.uk within the meaning of applicable telecommunications law. Accordingly, any complaints relating to such services should be directed by the user to the telecommunications operator whose services the user uses.
- Definitions
- Service – the CabinCrew.uk website, also referred to as the "Application", "Service" or "CabinCrew.uk", at www.cabincrew.uk, operating on an online platform owned by PWC, comprising a set of informational and sales pages together with graphic elements and the entire IT system architecture.
- User – a person using the Service. A user may be an adult with full legal capacity, or a minor with the consent of a legal guardian.
- Product, also referred to as Service – a service or digital content provided by PWC within the Service – such as an e-learning course, webinar, individual or group recruitment tasks, educational materials in the form of questions and answers on the recruitment process (including Final interview), or outside the Service – such as an on-site course.
- Payment operator – an external service responsible for processing payments, e.g. PayU, Przelewy24 or another. The payment operator operates under its own terms and privacy policy. The payment operator provides services to PWC under a separately concluded agreement.
- Order – selecting a product in the Service and making payment via the chosen payment operator. A paid order is equivalent to concluding a service agreement between PWC and the User. Failure to pay for an order is equivalent to its cancellation.
- Technical requirements
- Use of the Service requires a device with Internet access and a web browser capable of displaying web pages, supporting JavaScript and cookies. Use of current versions of browsers supported by their manufacturers is recommended.
- For Products constituting digital content or services provided online, the User should have hardware and software enabling playback or display of such content (e.g. PDF files, video materials or web pages) in accordance with the Product description. The Service Provider does not guarantee correct operation of the Service and Products on devices or in browsers that are not supported by their manufacturers or do not receive updates.
- The Service Provider informs that technical problems or limitations on the User's device or in their network environment (e.g. firewalls, blocks, antivirus software, browser settings, lack of updates, Internet provider limitations) may limit or prevent the User's access to the Service or use of Products.
- Rules of access to the Service
- Use of the Service may depend on installation of appropriate software required by the operating system provider on which the User's desktop or mobile device runs, or its updates.
- Correct operation of the Service may also require installation of updates or patches to applications provided by PWC.
- Costs of connecting the desktop or mobile device to the Internet arise from the agreement between the User and the relevant telecommunications operator.
- The User acknowledges that in some locations, due to poor Internet connection quality or lack thereof, the Service may not operate correctly or may be unavailable.
- Intellectual property and licences
- PWC holds all intellectual property rights to the Service, in particular PWC holds all rights to the name, domain, layout, graphic elements and all other creative elements of CabinCrew.uk.
- Upon opening the Service on the User's desktop or mobile device, PWC grants the User a non-exclusive, perpetual licence to use the Application and its resources for the purpose of viewing content and placing orders on CabinCrew.uk. PWC reserves the right to terminate the licence without notice in the event of the User's breach of these Terms.
- Use of the Service
- Use of the Application is voluntary.
- The Application is intended for individuals with full legal capacity or minors as defined under the User definition.
- Placing orders via the Service is possible after registration without login. PWC encourages Users to register. Some services or elements of the Service may be available only to registered Users.
- To register, the User must provide an active email address, first name, surname and mobile phone number. To create an individual account and be able to log in, the User must also provide address details and a unique password, and complete the verification procedure indicated by PWC.
- In the case of successful registration without login option, PWC will create an internal User profile for service delivery, to which the User will not have permanent access. Changing data for an order without login will require direct contact with the person running CabinCrew.uk or via email: support@cabincrew.uk.
- In the case of successful verification of registration with login, PWC will create a User profile in the Service where configuration settings and data provided during registration can be stored. The User will have permanent access to their data via login. This data will not be visible to other Users.
- To place an order, an unregistered User must provide their first name, surname, active email address and contact phone number, and complete the order form with their preferences, available dates and accept the relevant consents.
- Scope of PWC activities within the Service
- PWC may publish in the Service offers of its own products and those of third parties.
- PWC may publish in the Service advertisements and other promotional content for third-party goods and services.
- PWC endeavours to ensure the Service operates correctly but does not guarantee its continuous availability. PWC may temporarily suspend the Service when necessary to remove faults or improve its operation.
- PWC reserves the right to delete profiles inactive for a minimum of six months.
- PWC reserves the right to intervene in the user profile to remove irregularities in the operation of the Service and disruptions or problems with the profile.
- Any attempts to hack the Service, break codes or use them in breach of these Terms may result in immediate irreversible blocking of access to the Service and appropriate legal action.
- PWC reserves the right to cease providing services and to shut down the Service at any time.
- Service provision rules
- Use of the CabinCrew.uk Service is free of charge.
- Ordering a Product via the Service requires payment and registration.
- All prices of Products are gross prices and include tax at the rate specified by applicable law. The price shown for each Product in the Service is binding on the User and PWC at the time of placing and paying for the order.
- PWC reserves the right to change prices of Products in the Service offer and to run temporary promotional and discount campaigns, subject to Users' acquired rights and applicable law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Individual promotions and discounts do not stack. Changes do not affect Products already purchased.
- The following Products are available within the Service: (1) Product "CabinCrew.uk Course", also referred to as "Course", being an on-site course for a group of users at a selected location and date from the available calendar, or an online course if indicated in the Product description. (2) Product "Recruitment tasks" – sets of recruitment tasks in individual or group format, preparing for airline recruitment stages, provided as digital content in the Service. (3) Product "Final interview – questions and answers" – educational materials in the form of digital content comprising questions and answers and substantive comments on the final stage of recruitment (Final interview).
- Orders placed via the Service are processed using an external Payment operator and reservation system provider.
- PWC will exercise due diligence so that services provided to the User are of the highest quality, based on the latest knowledge and current market conditions in the airline sector.
- PWC has the right to cancel the Service in the event of insufficient number of places sold on the course or organisational/technical problems. If PWC cancels a course date, all Users who purchased the Product will receive a refund.
- The CabinCrew.uk Course programme is based on information obtained from airlines and experience gained by Instructors in their careers at various airlines, including Emirates Airlines, Qatar Airways, Etihad, British Airways, Virgin Atlantic, Ryanair, EasyJet and others.
- Selection of Instructors to run courses is made by selecting persons with appropriate professional experience, guaranteeing the highest quality of services provided by PWC.
- CabinCrew.uk Instructors are trained in accordance with the course programme to maintain quality standards and consistency of material across different locations in the UK and abroad.
- Digital products, including recruitment tasks and "Final interview – questions and answers" materials, are educational and simulation-based. PWC does not guarantee that specific questions, tasks or scenarios will appear in the actual recruitment process conducted by airlines.
- PWC does not guarantee the User employment with airlines after performance of the Service.
- PWC does not guarantee the User successful passage through recruitment to selected airlines.
- PWC guarantees that the materials, course programme and knowledge on airline recruitment are correct and effectively support the User in passing the recruitment process to selected airlines.
- The course programme does not violate the rights or internal procedures of airlines regarding cabin crew recruitment.
- PWC is not responsible for formal requirements of airlines or changes thereto.
- PWC is not responsible for the User vis-à-vis their future employer in the aviation industry.
- PWC does not train the User in aircraft technical handling procedures, first aid or internal procedures of airlines.
- PWC is not responsible for changes in the recruitment process made by carriers worldwide during or after performance of the Service.
- PWC has the right to refuse to perform the service for the User when: (1) The User uses the service for purposes inconsistent with its intended use or to the detriment of third parties or PWC. (2) The User breaches the law or these Terms.
- The User has no right to copy in whole or in part materials and knowledge made available under the service, including presentation slides, printed materials, video materials, or to present or distribute them. In the event of breach, PWC will seek contractual penalties under these Terms, in the amount of 10,000 PLN (ten thousand Polish zloty) net + VAT per single breach or copying and distribution of information constituting PWC's "know-how" and acquired knowledge used to provide services.
- PWC reserves the right to modify Products and the rules for their use in the Service, provided that purchased Products will operate according to the rules and dates chosen when placing the Order and on the terms described in these Terms.
- PWC reserves the right to modify contractual penalties in the event of breach of rights to copy, present and distribute materials described in point 8.7.
- Under these Terms, the User may not conduct competing activity or be employed by another entity conducting activity competing with PWC's activity for a period of 12 months from the date of the last service performed by PWC for the User.
- The User has the right to cancel the contract without giving a reason within 14 days of the date of purchase of the Product, i.e. conclusion of the agreement between PWC and the User. This right applies to both the CabinCrew.uk Course (on-site or online course) and to digital products (Recruitment tasks, Final interview – questions and answers), in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- To cancel, the User sends a clear notice of cancellation to: Pro Wojciech Cywinski, ul. Bernardyńska 23/65, 02-904 Warsaw, with the notation "Cancellation", or by email to: support@cabincrew.uk, stating the Product concerned (course or digital product) and the data provided at registration. Signature (required only for postal correspondence). For the Course (on-site or online): cancellation is conditional on non-use of the Product; a course already attended is not subject to refund. For digital products (Recruitment tasks, Final interview – questions and answers): the User acknowledges that they lose the right to cancel as soon as they have accessed the content (opening, downloading or being given access to the tasks or materials), subject to prior consent to commence performance before the 14-day period expires and to having been informed of the loss of the right to cancel. There is no refund once the User has accessed the tasks or other digital content. A service that has been paid for and performed is not subject to refund. The User has the right to complain about a defective service. Your statutory rights under the Consumer Rights Act 2015 are not affected.
- To preserve the cancellation period it is sufficient for the User to send the cancellation notice before the expiry of 14 days from the time of order payment.
- Effects of cancellation: if the User cancels this agreement, they will receive a refund of amounts due under the agreement without delay, and in any case no later than 14 days from the day the Service Provider was informed of the cancellation, in accordance with the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.
- Your statutory rights under the Consumer Rights Act 2015 (including rights as to the quality of digital content and services, repair, replacement, price reduction and refund where applicable) are not affected by these Terms.
- Orders and payment
- To place an order in the Service, the following steps must be completed: (1) Select the "Buy Now" button; (2) Complete the Order Form in the Service, including selecting the product, date and time from the calendar, location, providing personal data and approving the relevant consents for data processing by clear affirmative action (no pre-ticked boxes), in compliance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; (3) The User may also voluntarily consent to receive commercial information from PWC; (4) Select the "Pay" button on the form page; (5) Select one of the payment methods on the Payment operator page to which the User will be redirected; (6) Make payment on the Payment operator page; (7) After completing all the above steps and positive confirmation of registration and payment, the User will receive confirmation by email with guidelines and a summary of the selected Product and Order.
- Orders may also be placed by email or telephone.
- In all cases payment is made electronically via the Payment operator to PWC's payment account.
- PWC stipulates that the Service is performed only in the locations available in the order form.
- A VAT invoice is issued for each order in the internal order management system. The User has the right to request a VAT invoice at any time. The invoice will be sent to the User's active email address. A copy of these Terms will be made available to the consumer with the order confirmation or on a durable medium.
- Complaints and dispute resolution
- Every User has the right to lodge a complaint regarding the performance of the Service by PWC. For consumers in the United Kingdom, this is in addition to rights under the Consumer Rights Act 2015.
- Complaints regarding payment transactions, calendar handling or performance of the Service should be submitted to Customer Service at: support@cabincrew.uk or in writing to: Pro Wojciech Cywinski, ul. Bernardyńska 23/65, 02-904 Warsaw. Contact details for customer care are displayed on the Service.
- Complaints will be processed without undue delay, and in any event within 7 business days of receipt, unless exceptional circumstances apply.
- The response to the complaint will be sent to the User at the contact details provided when lodging the complaint by email or post.
- The Service Provider reserves the right to extend the period in point 10.3 by no more than 10 days where processing the complaint requires unusual, special actions and findings or encounters obstacles independent of and not attributable to the Service Provider (equipment failure, network failure, etc.).
- The law applicable to legal relations arising from Users' use of the Service is the law of Poland. For consumers in the United Kingdom, the Consumer Rights Act 2015 and the law of England and Wales (or Scotland or Northern Ireland as applicable) apply to consumer rights and disputes. The courts of England and Wales shall have non-exclusive jurisdiction in relation to consumers in the UK. In case of conflict between Polish law and mandatory UK consumer law, the provisions more favourable to the consumer under UK law shall apply.
- Disputes between the Service Provider and a consumer may be resolved through the complaint procedure set out above and, if not resolved, amicably through alternative dispute resolution (ADR) where both parties agree, or before the competent courts. Consumers in the UK may have access to certified ADR schemes.
- A case may be heard by an ADR body only after the complaint procedure has been completed and if both parties agree. Otherwise, any disputes are submitted to the courts having jurisdiction under applicable law.
- A consumer User may also use the EU online dispute resolution platform at: EU ODR platform (https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN).
- Pro Wojciech Cywinski agrees to participate in out-of-court consumer dispute resolution – contact by email: support@cabincrew.uk.
- Personal data protection
- The controller of Users' personal data is Pro Wojciech Cywinski with its registered office in Warsaw, ul. Bernardyńska 23/65, 02-904 Warsaw, which processes Users' personal data in accordance with applicable data protection law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
- Personal data in the registration and order forms are processed by the Controller for the purpose of accepting orders and performing agreements with the user. The Controller may also process this data for its legitimate interest in direct marketing of its own products and services. Sending commercial information to users by electronic means (email) requires the user's consent. Consent for processing of personal data and for commercial communications is obtained by clear, specific, informed and unambiguous affirmative action (no pre-ticked boxes) in compliance with UK GDPR and the Consumer Contracts Regulations 2013.
- The Controller has the right to make provision of its services and use of the Service conditional on verification of the user's personal data.
- Provision of data is voluntary. A user providing data has the right of access, rectification, restriction of processing, erasure, objection to processing, data portability where applicable, and the right to lodge a complaint with a supervisory authority. In the United Kingdom, the supervisory authority is the Information Commissioner's Office (ICO) – ico.org.uk.
- The User is obliged to provide correct data in the form and to update them.
- If the Controller has doubts as to the truthfulness or accuracy of data provided by the User in the registration form, the Controller may block the profile pending clarification and cancel the agreement between PWC and the User in respect of performance of the Service.
- The Controller may disclose Users' personal data only to competent public authorities and the judiciary acting on the basis and within the limits of the law, or to third parties where disclosure is required by law.
- If the User has given voluntary marketing consent – the User's personal data provided in the Service registration form or when editing it, and information on their activity, will be used to present the User with advertisements for products and services of our Trusted Partners, tailored to their interests.
- User obligations
- Each User may have only one profile and may not share it with others or use another person's profile.
- The User undertakes to refrain from actions that may hinder or disrupt the operation of the Service. If such actions are found, PWC has the right to block the profile, in addition to any other measures.
- The User undertakes to: (1) Comply with the law and good practice; (2) Not place false orders; (3) Pay amounts due for orders placed.
- The User declares that all content, including personal data, placed by them in the Service is true and does not infringe any third-party rights.
- Use of the Service in a manner contrary to its purpose is prohibited. Sending spam and unsolicited commercial information and conducting commercial, advertising or promotional activity on behalf of PWC is prohibited.
- Copying part or all of the Service or using it by the user for profit is prohibited.
- Cessation of service
- PWC reserves the right to block or delete the profile of a user whose actions breach these Terms.
- If PWC blocks a profile, creation of a new profile by the User requires PWC's prior consent.
- The User may at any time cease using the Service by deleting their profile.
- The Controller may require the User to change their password, update data and re-confirm consent to personal data processing.
- Changes to the Terms
- PWC is entitled to make changes to the Terms with effect for the future for the following reasons: (1) A new functionality of the Service is introduced that cannot be used under the current Terms; (2) The change is required by law; (3) The current functionality of the Service is changed, in particular to improve comfort or ease of use.
- Registered users will be informed of any change to the Terms by email at least 7 days before the change date. In addition, notice of the change will be displayed prominently in the Service or Application for 1 day from the date of the change.
- The change to the Terms takes effect from the date specified in the change notice.
- In the event of any change to the Terms, the user has the right to withdraw from the services with immediate effect.
